Terms of service

These terms are an agreement between you and ListSooner (“ListSooner,” “we,” “us”), an AI photo editing service for real estate operated by a sole proprietor based in Iowa. By creating an account, buying a plan, or uploading a photo, you agree to these terms and to our Privacy policy. If you use ListSooner for a company or team, you confirm you can accept these terms for it.

1. Accounts

• You must be at least 18 and give accurate account details.
• Keep your sign-in secure. You are responsible for activity on your account.
• Teams share the owner’s plan and credits. The owner pays for edits made by team members, and owners and admins can add, remove, and change members.

2. Plans, credits, and billing

• New accounts get a small number of free edits. Paid plans are monthly subscriptions, billed in advance through our payment processor, Stripe, and renew automatically until you cancel.
• One edit is one AI tool applied to one photo. Unused monthly edits roll over for one month. Edits bought as one-time packs do not expire while your account is open.
• You can cancel anytime from your account page. Your plan stays active until the end of the period you paid for. Payments are non-refundable except where the law requires otherwise or where we say so in these terms.
• If an edit fails, or our structure check finds the AI changed the room, we re-run it once for free and otherwise return the edit to your balance automatically.
• We may change prices. We will tell you at least 30 days before a change affects your subscription, and you can cancel before it takes effect. Prices do not include taxes that may apply.

3. Your photos

• You keep ownership of the photos you upload and the edited images you export, and you may use exports commercially, with no ListSooner branding. Virtually staged and concept images always carry a disclosure mark, and you agree not to remove, crop out, or cover it.
• You give us permission to store, process, and send your photos to our service providers as needed to run ListSooner for you: to make your edits, show them to you and your team, and keep them for the retention period below. We do not sell your photos.
• Showcasing your edits. You also give us a non-exclusive, worldwide, royalty-free, perpetual license to copy, display, and publish images you create with ListSooner, together with the photos they were made from, to show what ListSooner can do: on our website, in examples and galleries, in social media, ads, emails, and sales materials. We may crop or resize them and add before/after labels, but we won’t change what they show. We won’t publish your name, the property’s address, or other details that identify you or the property unless you agree, and we won’t use them to advertise the property itself. We may keep copies of images we select for this past the retention period below.
• You can opt out of showcasing at any time by emailing hello@listsooner.com. We will stop adding your images to new materials within 30 days and remove them from our website and galleries; we can’t recall copies already printed, sent, or shared by others.
• You confirm you have the right to upload each photo, including permission from the owner, the photographer, and any resident or occupant whose home or belongings appear in it, and the right to grant us the showcasing license above. If you don’t have that right for a photo, opt out before you upload it.

4. Accurate representation

ListSooner edits images with AI. Results can contain mistakes, so review every image before you publish it. You are responsible for how you use edited images, including labeling virtually staged, decluttered, re-timed, or otherwise enhanced photos as your MLS, brokerage, and local advertising and fair-housing rules require. See our disclosure guidance. Do not use ListSooner to hide defects, damage, or material conditions of a property. Development concepts are marked CONCEPT ONLY and must stay labeled as concepts.

5. Acceptable use

Don’t use ListSooner to:

• upload content you don’t have rights to, or that is unlawful, deceptive, or harmful;
• create images that mislead buyers, renters, or lenders about a property;
• get around credit limits, share an account between people outside a team, or scrape, overload, or reverse engineer the service.

We may suspend or close accounts that break these rules, and we may remove content that does.

6. Storage and retention

Uploaded originals are deleted once they are processed; anything left over is removed within two days. Finished edits are saved to your account for 30 days and then deleted, so download anything you want to keep. Copies we select for showcasing (section 3) are kept separately until you opt out. We are not a backup service.

7. Our service

ListSooner’s software, design, and brand belong to us. We may improve, change, or stop features. If we shut down a paid plan entirely, we will give you notice and refund any prepaid period you could not use.

8. Disclaimers

ListSooner is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t promise the service will be uninterrupted or error-free, or that any edit will meet a particular MLS or legal requirement.

9. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities. Our total liability for any claim about ListSooner is limited to the greater of what you paid us in the 12 months before the claim or $100.

10. Indemnity

You will defend and indemnify us against claims arising from photos you upload, images you publish, or your breach of these terms or the law.

11. Ending your account

You can stop using ListSooner and ask us to delete your account at any time. We may suspend or end access if you break these terms or if we must by law. Sections 3 through 12 continue to apply after your account ends.

12. Governing law

These terms are governed by the laws of the State of Iowa, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in Iowa, and you and we consent to their jurisdiction.

13. Changes

We may update these terms. If a change is material, we will tell you by email or in the app before it takes effect. Continuing to use ListSooner after that means you accept the updated terms.
